Generating Business with Good Contracts
Entrepreneurs often view lawyers as impediments to success.
The view is not completely misguided. After all, lawyers are trained to limit risks, and entrepreneurs know the importance of taking risks. A few principles can help to define the lawyer's role:
- Examining the extent of the risk is a rational use of a lawyer's skill.
- The elimination of risk creates a lost opportunity.
- Negotiating all risk from the client's side of a contract eliminates both sides' incentive to perform.
- The role of your lawyer should temper, but not negate, your entrepreneurial passion.
Choosing your Lawyer
It is wise to find a lawyer who has the ability to provide a rapid response to your demands and the judgment to make the right call. The lawyer's role is to advise you of the risks and to document your deal. The starting point in locating a lawyer for your business is to determine whether the lawyer has the inclination to understand your business.
